Terms of Lease
1. INTERPRETATION
- “Expiry Dates” means one month from the date notice is given to terminate the licence
- “Default Interest Rate” means 15% per annum
- “License Fee” means the sum of money that the licensee must pay the Licensor in consideration for the grant of the License, being $563.00 including GST per month
- “Plan” means the Plan attached to the Licence;
- “Premises” means part of the Licensor’s property at 1 Peter Robb Lane, Wanganui (shown on the plan)
2. LICENCE TO OCCUPY
- Subject to the Licensee’s observance of the conditions in this License, the License entitles the Licensee to occupy the unit at the Premises
- The Licensee shall have the right to pass and repass over the driveways and paths of the Premises so as to have access to the unit on the Premises in common with other licensees, the Licensor and third parties
- The Licence commences on the Commencement Date at which time the Licensee shall have access to the Premises
- The License is a minimum of 6 (six) months periodic license arrangement. After the initial 6-month period, should either party wish to end their arrangement with the other party for whatever reason, then the notifying party must give the other party one calendar months’ notice in writing. Any monies already paid will not be refunded
- In consideration of the grant of the Licence, the Licensee will pay the monthly Licence Fee, starting on the Commencement Date and every one month thereafter (“the Payment Dates”)

- Reference Unit Number: (e.g. 6/Peter Robb)
- If the Licensee defaults in payment of the Licence Fee under this Licence for five (5) working days, then the Licensee shall pay on demand interest at the Default Interest Rate on the moneys unpaid from the due date for payment to the date of payment.
- The Licensee shall comply with the reasonable directions and policies of the Licensor from time to time in relation to the Premises
- The Licensee must not:
- do anything which unreasonably interferes with other persons legal use and enjoyment of the Premises
- assign its rights under the License or sub-licence the Premises without the written consent of the Licensor
- The Licensor retains overall control of the Premises at all times and may enter upon the Premises for the purpose of checking the condition of the Premises and carry out works on the Premises as it sees fit
- The Licensee will use the Premises at its own risk.
- The Licensor will not be liable to the Licensee or to any other person for:
- any loss or damage sustained by the Licensee or any other person arising from the use of the Premises;
- theft or loss of any article belonging to the Licensee or to any other person;
- The Licensee shall indemnify the Licensor against all damage or claims arising out of the Licensee’s breach of obligations in this Licence
3. SPECIAL CONDITIONS OF LICENSE
The Licensee acknowledges the following special conditions of the licence agreement:
- Access fobs or cards or auto door and gate remotes and keys provided to the Licensee by the Licensor at Commencement date shall remain the property of the Licensor and shall be returned to the Licensor at Licence expiry.
- A refundable deposit of $200.00 including GST is payable at the commencement date in exchange for the access fobs or cards or auto door and gate remotes and keys referred to in 3(a) above
- The deposit is refunded conditional upon the return of the access fobs/cards/remotes/keys in good working order.
- In the event the Licensee requires replacement of the missing access items a) above the Licensor shall advise the Licensee of the appropriate replacement of such items which are payable by the Licensee.
- The Licensor provides power to a double single phase power outlet for the use of the Licensees personal equipment and such power outlet shall not be connected to a multi-plug for excessive power draw.
- The Licensor provides LED lights which are controlled by a 2 (two) hour delay switch off.
- Fish filleting is strictly prohibited at 1 Peter Robb Lane either inside or outside the Licensees particular unit.
- Rubbish disposal is the sole responsibility of the Licensee. For the avoidance of doubt the Licensee shall pay the costs of their own rubbish collection and recycling charges.
- Early termination due to extenuation circumstances may be approved by direct negotiation with the Licensor and by payment of a 2 (two) month rental early termination fee.
- In the event of an early Termination deemed by the Licensor to be non-extenuating circumstances the Licensee shall be liable for payment of the rental for the remainder of the licence period until expiry.
- Designated parking is provided for the benefit of Licensees and invites within the confines of the property facing Mill Road.
- For the benefit of vehicle movements at the location, Licensees are requested not to park for long periods outside the front of the units.
